Oheruk I. About list of corruption crimes provided by the criminal code of Ukraine

Purpose. The aim of the work is to analyze the list of corruption crimes, which is provided by the Criminal Code of Ukraine, for compliance with the signs of the statutory concepts of “corruption” and “corruption offense” specified in the Law of Ukraine “On the Prevention of Corruption”. Methodology. The methodology includes a comprehensive analysis and synthesis of the available scientific and theoretical material and the formulation of relevant conclusions and recommendations. In the course of the study, the following methods of scientific knowledge were used: terminological, logical-semantic, system-structural, logical-normative. Results: in the course of the study, mandatory signs of legally enshrined concepts of “corruption” and “corruption offense” are defined, which are specified in the Law of Ukraine “On the Prevention of Corruption” in the context of the science of criminal law. On the basis of the obtained results, the list of corruption crimes, which is provided by the Criminal Code of Ukraine, is analyzed. Originality. The study found that the inclusion of articles 210 and 354 of the Criminal Code of Ukraine in the list of crimes of corruption has been controversial, since it didn’t contain all the mandatory signs of the concept of “corruption”, and therefore cannot be considered as a “corruption offense”, which was defined by the Law of Ukraine “On preventing corruption”. Practical significance. The research results can be used in lawmaking in the improvement of anti-corruption legislation.
