Babetska I. Artificial intelligence: issues and prospects of legal regulation of interests in the field of intellectual property
Purpose. The purpose of the article is to define the concept of «artificial intelligence» and to clarify the issue of the mechanism of turnover of objects created using artificial intelligence. The article is devoted to the study of the current state of international legal regulation of artificial intelligence and the determination of prospects for the development of legislation of Ukraine. Methodology. The methodology includes a comprehensive analysis and generalization of the available scientific and theoretical material and the formulation of appropriate conclusions and recommendations. During the research, the following methods of scientific knowledge were used: terminological, dialectical, logical-semantic, logical-normative, system-structural. Results. The purpose of this research was to establish the most relevant areas of legislative regulation of AI and to determine measures to solve them. It is proposed to define AI as an organized set of information technologies and systems, created to perform systemic complex tasks, capable of independence and self-improvement of already existing created objects of intellectual property rights. Scientific novelty. During the research, it was found that almost all problematic aspects of the development, use and implementation of AI are associated with the imperfection of the regulatory and legal regulation of relevant social relations at both the international and national levels. To ensure legal regulation in the field of objects created with the help of AI, the position is supported on the adoption of a new or improvement of an existing international regulatory legal act regulating the development and use of AI, which would be binding on the national legislation of potential member states of such an act and would enshrine guiding provisions. In line with the alignment and improvement of legal regulation, it is necessary to amend the Law “On Copyright and Related Rights” in order to clarify the legal status of works created using AI. Introduce criteria for assessing human contribution and create registration platforms for identifying AI and user contributions. Practical significance. The results of the research can be used in law-making activities for the purpose of legal regulation of civil relations.
