Lutskyi R., Coughlan V., Tabachyn V. Law and legal reality as categories of interaction

Purpose. The purpose of the article is to provide for a structural and functional analysis of legal reality as a philosophical and legal category through the prism of existence and implementation of law; to study the normative and imperative and formally defined section of legal reality as a social phenomenon. In addition, one of the defining features of the development of modern Ukrainian society is its military nature, which is stuck in a transitional stage marked by significant contradictions related to the breakdown of the old system based on communist ideology and the gradual transition to modern democratic standards of civilized development of most countries of the world. This statement significantly actualizes the study of the phenomenon of legal reality and certain ways of its comprehension by social actors on the basis of new value orientations. Methodology. In order to achieve this goal, the author conducted a comprehensive analysis of the available information on the issue under consideration and formed conclusions and proposals based on the same. The following methods of scientific cognition were used in the course of the study: dialectical, system-structural, terminological, system-functional, historical, normative-dogmatic, and generalization methods. Originality. For the first time, the author investigates the philosophical aspects of the deontological nature of legal reality as a structured plane of law implementation.  Practical significance. The results of the research can be used in law-making and human rights activities regarding the implementation of current legislation in wartime. In addition, they have an important theoretical component in the educational process when teaching and studying the disciplines «Theory of State and Law», «The Rule of Law and the Legal System of the European Union», and «Lawmaking and Law Enforcement».

Key words: law, rule of law, reality, social reality, society, state, systemicity, mandatory nature, social essence of law.
