Makarchuk V. Military Police as a Potential Subject in the Formation and Implementation of State Policy in the Sphere of National Security and Defense

Purpose. The aim of the work is to analyze the role of the military police as a future subject in the formation and implementation of state policy in the sphere of national security and defense, defining its functions, powers, and place within the system of law enforcement agencies. Methodology. The methodology includes a comprehensive analysis and synthesis of existing scientific and theoretical materials, utilizing the following methods of scientific inquiry: terminological, logical-semantic, functional, systemic-structural, and logical-normative. Results. The creation of the Military Police is aimed at increasing the effectiveness of maintaining law and order and discipline in the Armed Forces of Ukraine. The new structure will receive broader powers compared to the Military Law and Order Service, in particular in the field of operational and investigative activities and ensuring the security of key military leaders. This will improve coordination between law enforcement agencies and ensure the inevitability of punishment for offenses in the military sphere. The main arguments for reforming the Military Law and Order Service into the Military Police are well-founded and take into account the key risks associated with this process, especially in conditions of martial law and large-scale war. Reforming the Military Law and Order Service into the Military Police is an important step towards improving the system of maintaining law and order in the Armed Forces of Ukraine. However, this process must be carefully prepared and implemented in favorable conditions, after the end of martial law. A comprehensive approach to reform, including the creation of specialized prosecutorial bodies and courts, will ensure the effectiveness and independence of the new military justice system. Scientific novelty. The research determined that the theoretical and methodological model of the military police’s functioning should be updated based on international standards, particularly those of NATO. Practical significance. The results of the study can be used in legislative and law enforcement activities during the reform of the military justice system and the establishment of the military police.
