Markova O. Military Police as a Potential Subject in the Formation and Implementation of State Policy in the Sphere of National Security and Defense

Purpose of this study is to conduct a comprehensive analysis of the role of the Conseil d’État (Council of State of France) in the formation of the French model of administrative procedure, focusing on its legal status, judicial and advisory functions, and its influence on codification processes, particularly the adoption of the Code of Administrative Procedure (CRPA). Methodology employs an integrated approach combining historical-legal, institutional, formal-dogmatic, and comparative law methods, enabling an in-depth understanding of the evolutionary and functional characteristics of the Conseil d’État within the broader European and American administrative law context.

Findings include a detailed examination of the Conseil d’État as the supreme administrative court and advisory body to the government, which performs regulatory functions and exerts significant influence on the development of France’s administrative procedural system. The study demonstrates how the jurisprudence and recommendations of the Conseil d’État contributed to the codification of administrative procedure, representing an effective synthesis of judicial practice and legislative activity.

Scientific novelty lies in the comprehensive interdisciplinary analysis of the Conseil d’État’s role in shaping modern French administrative procedure, supplemented by a comparative analysis with analogous institutions in other European countries and the USA, which reveals the particularities of its institutional development and functions. Practical significance of the research stems from the applicability of its results to the reform and improvement of administrative procedure in Ukraine, notably through the adaptation of best European practices and codified procedures into the national administrative law framework.
