Purpose. The purpose of the article is to investigate the practical possibility of using assisted reproductive technologies in Ukraine in the field of posthumous human reproduction for military service members during the war in Ukraine, and to propose legislative changes for the earliest possible implementation of this legal reform in order to preserve the gene pool of the Ukrainian people. Methodology. The methodology includes the complex use of scientific approaches and principles, as well as general scientific, philosophical and special scientific methods. Originality. The article presents a scientific study aimed at resolving the demographic crisis in Ukraine by introducing a new reform in the field of assisted reproductive technologies, namely through legislative regulation of posthumous reproduction in Ukraine in wartime conditions. Findings. The article shows the close relationship between the protection of the reproductive health of the population and the preservation and protection of the gene pool of the people of Ukraine in wartime with the aim of the post-war restoration of the state. Practical significance of the study. The results of the study can be used to develop legislative amendments in the specified area of human rights and bring the current legislation into line with them, as well as with the principles and norms of European and international law. The conclusions of the study can be useful for legal specialists, as well as for the work of interdisciplinary working groups in carrying out their legislative activities in the field of assisted reproductive technologies. In particular, legislative changes in this area may finally resolve the problem of establishing state control over surrogacy services in Ukraine, which were previously provided mainly by private clinics on a commercial basis.
