Purpose. The purpose of the scientific work is to study the issues of delimiting the subject jurisdiction of the Constitutional Court of Ukraine and courts defined by law as administrative. Methodology. The methodology includes the comprehensive use of scientific approaches and principles, as well as general scientific, philosophical and special scientific methods. Results. Within the framework of the scientific article, a comparative analysis of the subject jurisdiction of courts defined by law as administrative and the Constitutional Court of Ukraine has been conducted. It has been established that within the framework of constitutional and administrative proceedings, tasks similar in form and content are performed, but at the same time, a number of differences between them have been noted. The work proposes seven independent criteria that we propose for use in determining the appropriate subject jurisdiction: subject composition; nature of legal relations; form of appeal of the subject of law; form of judicial review; types of decisions adopted within the framework of judicial review; functions within which proceedings are carried out (types of control); legal regulation of the process. Scientific novelty. Seven independent criteria for the distinction between administrative and constitutional jurisdiction are proposed. The analysis we propose and its results will positively influence the process of further reforming the subject jurisdiction of administrative courts in the context of the emergence of fundamentally new public legal relations. In addition, subject to the adoption of the Code of Constitutional Procedure of Ukraine, the criteria we propose may form the basis of the subject jurisdiction of the Constitutional Court of Ukraine enshrined in the code. Practical significance. The proposed results of the study can be used by the Supreme Court and the Grand Chamber of the Supreme Court if there is an exceptional legal problem, the need to change the jurisdiction of a particular category of cases.
