Goal. The purpose of the study is to determine the meaning of the definition of “force of operational and investigative activity” and its derivative “force of operational and investigative activities of the National Police”. In particular, it is determined that, to date, there is no consensus among scientists about the meaning of this definition, and the analysis of current legislation suggests that the legislator understands the force of operational and investigative activity of all possible actors of such activity, however, it remains unclear whether attributes the legislator to the forces of the ORD not only the relevant operational units, but also other categories of subjects whose right to engage in operational-search activities is provided for in other provisions of the said Law. Method. The methodology includes a detailed comprehensive analysis and synthesis of available scientific and theoretical material on the raised issues, on the basis of which grounded worldview conclusions and recommendations on disclosure of the essence of the studied concepts are made. Results On the basis of systematized material and analyzing the dangers of the negative effects of the introduction of gender theory, we aim to attract attention and encourage theoreticians and contemporary legislators to in-depth study of this problem. Scientific novelty. The article analyzes the fundamental researches and views of theorists in the sphere of operative-search activity and describes the positive, as well as the negative aspects of the influence of this term on domestic legislation. For the first time, the definition of the definition of the “ORD force” was given on the basis of an analysis of not only the current legislation, but also the opinion of practical workers of the National Police of Ukraine. Practical significance. The results of the study will contribute to the improvement of the theoretical and applied principles of operational-search activity.
