Masliy E. D. Separate aspects of legal regulation of operational and investigative counteraction to the illegal sale and acquisition of narcotic drugs, psychotropic substances and their analogues

Goal. The purpose of the study is to determine the current state of the legal regulation of operational and investigative counteraction to the illegal sale and purchase of narcotic drugs, psychotropic substances and their analogues, existing problem aspects and perspective ways of their elimination. Method. The methodology includes a detailed comprehensive analysis and synthesis of available scientific and theoretical material on the raised issues, on the basis of which grounded worldview conclusions and recommendations on disclosure of the essence of the studied concepts are made. Results The current state of legal regulation of operative and investigative counteraction to the illegal sale and acquisition of narcotic drugs, psychotropic substances and their analogues is characterized by the presence of a large number of regulatory acts that directly or indirectly affect it, the presence of problematic aspects that require urgent resolution, not only by making changes and additions to various normative acts regulating the outlined process, but also the mandatory involvement of practical workers by the legislator when updating or developing provisions of new laws. Scientific novelty. The article analyzes the fundamental researches and views of the theoreticians of operative and investigative activity on the issues of legal regulation of operational-search operations, in particular, the legal regulation of operative and investigative counteraction to illicit sales and the purchase of narcotic drugs, psychotropic substances and their analogues. For the first time the modern problem aspects of this problem and the perspective ways of their elimination are determined. Practical significance. The analysis of empirical material shows that promising ways of eliminating these problematic aspects of the legal regulation of the operative and investigative counteraction to the illegal sale and acquisition of narcotic drugs, psychotropic substances and their analogues are both the introduction of amendments and additions to the various normative acts regulating the process outlined and the involvement of practical workers by the legislator when updating or drafting new provisions of the legislation ..
