Matsak V. V. Legislation of legal guarantees after the performance of audio- and video personal control

Goal. The purpose of the article is to determine the current state of legislative regulation of guarantees of legality during the conduct of audio and video monitoring of a person, the existing problem aspects and the perspective ways of their elimination. Method. The methodology includes a detailed comprehensive analysis and synthesis of available scientific and theoretical material on the raised issues, on the basis of which grounded worldview conclusions and recommendations on disclosure of the essence of the studied concepts are made. Results It was stated that although the legislative acts provide for the organizational and legal basis for ensuring legal guarantees during the audio and video monitoring of a person, there are some significant shortcomings that require urgent amendments and additions to such normative acts as the Criminal Procedure Code, the Law of Ukraine “On Operative- search activity “, the Law of Ukraine” On ensuring the safety of persons involved in criminal proceedings “, etc. Scientific novelty. The article defines for the first time the existing problematic aspects of legislative regulation of the guarantees of legality during the implementation of audio and video control of a person and possible ways of its elimination. Practical significance. The results of the study contribute to the improvement of the current legislation of Ukraine, elimination of problematic issues, as well as increase the effectiveness of the implementation of audio and video monitoring by the personnel of the National Police of Ukraine in the process of counteracting crime.
