Andrusiv L. The concept of «possession» in the practice of the European court of human rights

Purpose. The purpose of the article is to reveal the concept of «property» and determine its characteristics in the case law of the European Court of Human Rights

Methodology. The methodology includes a comprehensive analysis and generalization of the case law of the European Court of Human Rights, scientific positions and the formulation of the relevant features. The following methods of scientific cognition have been used during the research: dialectical, hermeneutic, method of analysis and synthesis, prognostic, systemic and formal-legal. Results. In the course of the research it has been stated that the interpretation of the concept of property in the Civil Code of Ukraine and the practice of the European Court of Human Rights are different. The cases against Ukraine in which a violation of Article 1 of Protocol No. 1 to the Convention was found have been considered and the facts constituting the violation have been singled out. It has been emphasized that, according to the case law of the European Court of Human Rights, arrears constitute property for the purposes of Article 1 of Protocol No. 1. The autonomy of the concepts of «property», «possession» is highlighted and a much broader approach to the concept of «possession» is used compared to the national legislation of Ukraine, as the European Court is not limited to property rights and is not bound by formal classifications. Practical significance. The results of the study can be used to improve the legal regulation and legal consolidation of the concept of «possession», as well as in the trial.
