Odarchenko M. S., Stashchak M. V. Comparative analysis of foreign legislation on the provision of guarantees of liability under the operational and sustainable activity

Goal. The aim of the study is to carry out a comparative analysis of foreign legislation on the issue of guaranteeing the legality of conducting operational and investigative activities. Method. The methodology includes a detailed comprehensive analysis and synthesis of available scientific and theoretical material on the raised issues, on the basis of which grounded worldview conclusions and recommendations on disclosure of the essence of the studied concepts are made. Results As a result of the research, the prospective directions of implementation of international experience have been identified. In particular: 1) the legislation of the United States of America and the Republic of Armenia is constructed in such a way as to ensure legal certainty in conducting operational search activities at all its stages, as well as at all levels of legal regulation of the country’s life; 2) in the Republic of Armenia, unlike the United States of America, operational search activities are a separate area of activity of law enforcement bodies (in particular, in Ukraine), which the latter are authorized to apply only in the framework of operative and investigative proceedings, as well as part of procedural activities, as they can conducted by authorized operational units prior to the opening of criminal proceedings, which does not allow full prosecution control and judicial supervision over their conduct; 4) a comparative analysis of the legislation of the United States of America and the Republic of Armenia on the issue of securing legality in the course of carrying out operational search activities showed that there are certain rules that are promising for testing in the form of an experiment in certain territories, which results in a final decision on their implementation into national legislation. Scientific novelty. Scientific novelty was expressed in the fact that the author of the article defined the perspective directions of the international practice of legislative regulation of the issue of guaranteeing legality during the conduct of operational and investigative activities. Practical significance. Interviewed operational officers of the National Police of Ukraine, as well as employees of the regime’s secret police units, state that today there are a lot of problem and conflict issues. Taking into account the aforesaid the author determines the possible ways of their elimination by introducing international experience.
