Gabuda A. S., Savyuk O. V. Problems of criminalization of blackmail

The article raises the issue of establishing criminal liability for blackmail. An analysis of the draft Law amending the Criminal Code of Ukraine (regarding criminal liability for blackmail) No. 8005 dated 02/06/2018 is underway. Taking into account the scientific developments on this issue and the provisions of the law on criminal liability, the statement that blackmail is a way to achieve a criminal result is substantiated. Therefore, the issue of the criminalization of blackmail is proposed to be resolved through the prism of established doctrinal views and legislative approaches in which the socially dangerous action or inaction, and not the method of committing a crime, are decisive in determining the crime and punishment of the act.
