Lutskyy A. I. Prospects of positivist ideology in the context of globalization (historical and legal aspect)

The article provides the author’s vision regarding the perspective of a positivist ideology in the context of globalization. Based on the analysis of the philosophical and legal doctrine of positivism, three levels of its influence on the legal ideology are distinguished. A clear distinction is made between the ideas of positivism, neo-positivism and post-positivism and their application in our time. The author comes to the conclusion that positivism cannot cover the whole structure of legal ideology, based on domestic social and legal realities. Significant negative positivism, in the conditions determined by its failure to reflect the ideological vectors of the functioning and development of law in a dynamic system of social relations.
