Filchakov A. V. The current state of scientific development of the issue of prosecutor’s oversight of legality in conducting operational-search activities by units of the criminal police

Goal. The purpose of the study is to determine the state of scientific development of the issue of prosecutorial supervision over the observance of lawfulness in the conduct of operational-search activities by units of the criminal police; outline of problem issues that have not found their scientific reflection and identify prospective ways to eliminate such a problem. Method. The methodology includes a detailed comprehensive analysis and synthesis of available scientific and theoretical material on the raised issues, on the basis of which grounded worldview conclusions and recommendations on disclosure of the essence of the studied concepts are made. Results On the basis of systematized material and analyzing existing scientific works, we aim to draw the attention of the scientific community to the problems of prosecutor’s supervision of the observance of the lawfulness of conducting operational-search activities by the units of the criminal police in order to optimize such activities, in particular by conducting a comprehensive monographic study on the above-mentioned problems. Scientific novelty. The article analyzes both fundamental researches and fragmentary works of theorists and practitioners on issues of prosecutorial supervision over the observance of the lawfulness in carrying out operational-search activities by units of the criminal police. Practical significance. The results of the survey directly point to the lack of attention from the specialists in the area of the ORD on the prosecutor’s oversight of law enforcement in the conduct of investigative activities by the units of the criminal police and the need to research the problem issues of such activities and identify ways to eliminate them.
